Onramp Bitcoin – Acceptable Use Policy

We have included annotations in italics to emphasize certain portions of our policy.  They are not summaries, so please read everything to avoid activities that could terminate your access to Onramp’s Services.

By using Onramp you agree to the terms outlined in this policy.  If you use Onramp on behalf of your company, your company agrees to them too.

The Onramp Terms of Service (available here) govern Client’s use of Onramp, this Acceptable Use Policy (the “Policy”), and any other terms, policies and guidelines applicable to the Services (as the term is defined in the Onramp Terms of Service).  Onramp may modify this Policy by posting a revised version on onrampbitcoin.com.  Each time Client uses the Service, Client agrees to the latest version of this Policy.  Capitalized terms without definitions shall have the meaning given to them in the Onramp Terms of Service.

I. Prohibited Activities

To ensure that Onramp’s Platform and the Onramp Multi-Institution Custody Service remain a safe space for you and your bitcoin, we do not allow harmful or illegal activity like fraud.

Except where prohibited by law, Client may not use, facilitate use of, or allow others to use, the Services to engage in the following activities (“Prohibited Activities”).

The specific types of use listed below are representative, but not exhaustive.  By using the Services, Client acknowledges and agrees that Client will not use the Services to do any of the following:

Activity involving illegal and other related substances

Activities including engaging in any criminal or tortious activity, including, without limitation, child pornography, trafficking in obscene material or drug dealing.  Also, Client may not sell narcotics, controlled substances, substances that provide the same effect as an illegal drug, despite such substance’s legal status (e.g., salvia, delta-8 and kratom), and any equipment designed for making or using drugs, such as bongs, vaporizers and hookahs.

Allowing a minor to use Onramp

Individuals below 18 years of age may not use the Services.

Breach of laws or regulations.

Activities that constitute a breach of any law, statute, ordinance or regulation of an applicable jurisdiction.

Breach the Terms of Service.

Activities that constitute a breach of the Terms of Service or any agreement incorporated by reference into the Terms of Service. 

Fraud and deceptive activity

Activities that defraud Onramp, Onramp customers or any other person or entity that provide any false, inaccurate or misleading information to the Onramp.

Hacking and malicious activity

Activities that, without limitation, (i) impose an unreasonable or disproportionately large load on Onramp’s infrastructure or detrimentally interferes with, intercepts or expropriates any system, data or information, (ii) transmit or uploads any material to the Services that contains viruses, trojan horses, worms or any other harmful or deleterious programs, (iii) attempt to gain unauthorized access to the Services, other Onramp customers’ bitcoin, computer systems or networks connected to the Services, through password mining, scraping or any other manual or automated processes, (iv) use another party’s information to access or use the Services, except where expressly authorized by a user to access such information or transfer Client’s access or rights to the Services to a third party, unless by operation of law or with Onramp’s express, written permission in advance or (v) harvest or otherwise collect information from the Services about others, including but not limited to personal information such as phone numbers or customers’ names, without proper consent.

Infringement

Activities that, without limitation, (1) constitute an infringement or violation of any copyright, trademark, right of publicity or privacy or any other proprietary right under the law, (2) use the intellectual property of Onramp without Onramp’s prior written consent or (3) imply an untrue endorsement, sponsorship or affiliation with Onramp.

Publication without authorization

Activities that, without limitation, (1) distribute, publish, broadcast, reproduce, copy, retransmit or publicly display any of Onramp’s intellectual property, (2) modify or create derivative works from any website or page carrying the “Onramp” name, (3) use any data mining, robots or similar data gathering or extraction methods on Onramp’s intellectual property or websites or pages carrying the “Onramp” name or (4) download any portion of Onramp’s intellectual property or a website or page carrying the “Onramp” name , other than for purposes of page caching, except as Onramp explicitly allows through its prior written consent. 

Select activity with certain countries and individuals

Activities that may be in violation of regulations administered by the United States Department of the Treasury’s Office of Foreign Asset Control (31 C.F.R. Parts 500-599).  This includes, without limitation, the provision of Services to or for the benefit of a jurisdiction, entity or individual blocked or prohibited by relevant sanctions authorities, including, without limitation, activities in Iran, Cuba, North Korea or Syria.  If Onramp finds Client to be in apparent violation of these restrictions, Onramp may terminate Client’s access to the Services and the Client’s funds could be held for an indefinite period of time.

II. Actions Onramp can take

We strive to make Onramp accessible to everyone.  However, if you do not follow our policy, we may block you from using the Services and share information about you and your activity with law enforcement.

Onramp has no obligation to monitor the Services for violations of this Policy, but it has absolute discretion to take any action up to and including suspending or terminating Client’s use of Onramp and the Services at any time, and without notice, for any violations of this Policy that are reported to it.

Onramp may investigate any suspected violation of this Policy, and remove or disable access to any content or resources that violates this Policy.  Client agrees to cooperate with Onramp to remedy any violation.

If Onramp reasonably suspects that Client has used the Services for an unauthorized, illegal or criminal purpose, Client gives Onramp express authorization to share information with law enforcement about Client, Client’s use of the Services and any of Client’s transactions.
